Plain-English summaries of the documents that govern Waitery. Each section links to the full PDF on request.

1. Terms of service

These Terms govern your access to and use of the Waitery platform — the Restaurant Panel, Web Ordering App, Waiter App, KDS, Cashier App, and Admin Panel — and the hardware that Waitery ships.

1.1 Eligibility

Waitery is sold to legal entities operating restaurants in Canada. You must be authorized to bind your business when you sign up.

1.2 Subscription

The base subscription is CA$14 per location per month, plus a one-time CA$250 setup fee per account. Add-on modules are billed monthly per location at the rates published on the Pricing page. Prices in CAD, exclusive of applicable taxes.

1.3 Term & cancellation

Subscriptions are month-to-month. Cancel with thirty (30) days' written notice to hello@waitery.com. Hardware purchased is yours; hardware leased remains Waitery's property until the lease term completes (CA$1 buyout).

1.4 Acceptable use

  • You won't reverse-engineer the platform or attempt to extract its source.
  • You won't use Waitery to process transactions in violation of the Card Brand Rules or applicable law.
  • You're responsible for the accuracy of menus, taxes, and tipping configuration on your account.

1.5 Disclaimers & liability

Waitery is provided "as is." Our aggregate liability under these Terms is limited to twelve (12) months of subscription fees. Nothing here limits liability for fraud, gross negligence, or anything that can't be limited under Canadian law.

1.6 Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputes are subject to the courts of Ontario.

2. Pre-Authorized Debit (PAD) agreement

By signing up, you authorize Waitery to debit your designated chequing account on the 1st of each month, in accordance with CPA Rule H1 and the CPA 005 PAD framework.

2.1 What gets debited

  • Base subscription · CA$14 per location.
  • Active add-on modules · per location.
  • Hardware lease instalments · if applicable.
  • Convenience-fee remittance and applicable GST/HST.

2.2 Variability

This is a Variable PAD. The amount changes month-to-month based on add-on usage, location count, and convenience-fee volume. Waitery will provide an itemized statement at least three (3) business days before each debit.

2.3 Your rights

  • You may revoke this PAD authorization at any time with thirty (30) days' notice.
  • If a debit isn't authorized or doesn't match your agreement, you can dispute it through your financial institution.

3. Privacy policy (Quebec Law 25 + PIPEDA)

Waitery is committed to handling personal information responsibly. We comply with Canada's federal Personal Information Protection and Electronic Documents Act (PIPEDA) and Quebec's Act respecting the protection of personal information in the private sector (Law 25, in force as of September 2023).

3.1 What we collect

  • From restaurants: business details, banking info for PAD, owner identity, location data, menus, staff records.
  • From guests using the Web Ordering App: order history (always), email/phone if entered for receipts, payment tokens (via Clover, never raw card data), optional account profile, allergy notes if provided.

3.2 Where it lives

All personal information is stored in AWS Canada (ca-central-1). Data does not leave Canadian-region servers in normal operation.

3.3 Law 25 rights

  • Access & rectification. Request a copy of, or correction to, your personal information.
  • Deletion. Guest accounts can request deletion at any time. Waitery fulfills deletion within thirty (30) days as required.
  • De-indexing. Request that information about you be de-indexed from search results, where applicable.
  • Portability. Receive your data in a structured, commonly used format.

Send privacy requests to our Privacy Officer at privacy@waitery.com. We respond within thirty (30) days.

3.4 What we never do

  • We never sell personal information.
  • We never store raw card numbers — payments are tokenized through Fiserv/Clover.
  • We never share guest data between restaurants without consent.

3.5 Cookies

Waitery uses essential cookies for session management. Optional analytics cookies (privacy-respecting, no cross-site tracking) can be disabled from your browser. We do not use advertising cookies.

4. Accessibility statement

Waitery aims to meet WCAG 2.2 Level AA across the marketing site, Web Ordering App, and Restaurant Panel — and to comply with Ontario's Accessibility for Ontarians with Disabilities Act (AODA).

4.1 What we commit to

  • Color contrast ≥ 4.5:1 for body text and 3:1 for large text and UI controls.
  • Keyboard-navigable interfaces with visible focus states.
  • Touch targets at least 24 × 24 CSS pixels (48 × 48 on touch surfaces).
  • Respect for prefers-reduced-motion.
  • Semantic HTML and ARIA labels where helpful.
  • Consistent placement of help and support across pages.

4.2 Reporting issues

If you encounter an accessibility barrier, please email accessibility@waitery.com. We aim to respond within five (5) business days.

Documents on this page are available in large print, audio, or French upon request.
